Withdrawal of points is a law enforcement sanction for a traffic violation. This does not involve a priori penalties on your insurance policy.
The insurer is not informed of an offense to the extent that the offense does not result in liability. The bonus-malus coefficient is also not affected by a loss of points, except in the event of a responsible accident.
The responsible accident is sanctioned
Any change in the event of a responsible accident. In this case, the insurer may take financial penalties to the destination of the insurance, such as an increase in the first insurance or limited access to certain additional guarantees.
It is then an additional penalty, to compensate for irresponsible behavior that has led to an increase in risk. But the loss of points can result in suspension, cancellation or invalidation of the permit.
In case of suspension, the financial sanction depends on the duration and recidivism.
For suspensions of less than two months, the majority of insurers may be lenient, but your company must be notified; between two and six months, the sanction is a possible increase of 50% of the premium; if the suspension exceeds six months, the increase can reach 100% of the premium.
In the case of multiple suspensions over a period of 3 years, this is a tripling of the premium. After two years without an offense, the sanction is revoked.
Termination of insurance
The Insurance Code obliges the insured to keep the company informed of license suspensions. What they don’t do. From 24 May 2018, a decree allows, in particular for insurers and employers, the possibility of questioning the SNPC (National Driving License System). A verification that is only possible in the event of an accident.
If the permit is not valid on the date of the claim, the insurer may reimburse the compensation. The contract may also be terminated ex officio, as well as the suspension following an accident caused by a state of alcohol or narcotics.
