At the end of the health questionnaire for certain credits

Unless required by law, borrower insurance is generally required by banks for a home loan, especially for the acquisition of a primary residence. Buyers who suffer from a health problem or a chronic illness, or who have had a serious illness, are often subject to surcharges and / or exclusion of warranties.

What will not be the case, however, for some loans, from 1er June, thanks to the entry into force of the flagship measure of the law of February 28, 2022 “for a fairer, simpler and more transparent access to the borrower insurance market”, the so-called Lemoine law: the end of the questionnaire medical.

The insurer will no longer be able to ask you for information about you “No medical examination”says the law, for real estate loans of up to 200,000 euros (this is the share insured by the borrower that counts, “On the cumulative outstanding amount of credit agreements”). Provided the credit is completed before the age of 60.

Borrower insurance: easier termination

At what time of year can you change your home loan insurance? Until now, the approach was feasible at any time during the first year of the contract, then once a year, on its anniversary date. From 1er June, it will be simpler: for new loans, the insurance becomes terminable at any time, regardless of the age of the loan, in accordance with the Lemoine law. The measure will apply to old credits in September.

Borrowers who have taken out group insurance from their bank will therefore be able, if they find it better elsewhere, to go to a so-called “delegated” insurer, an external insurer, without worrying about timing. Often savings can be made, especially for the best cases (les plus jeunes, en CDI, etc.). The condition for the lender to be accepted remains the same: the new contract must have equivalent guarantees.

Another novelty: before signing the loan, the bank will have to indicate to the borrower the total amount that the proposed insurance will cost him over the entire term of the loan (this was already the case), but also over eight years. Practical information, as loans are often repaid before the end of their initial term, and bare insurance monthly payments are not necessarily fixed (they are sometimes degressive). The insurer must also inform the borrower of its right to terminate each year.

Retirement savings, life insurance: more transparency on expenses

There are many costs, which weigh on yields and are, moreover, not very transparent for the saver looking to compare contracts: this is the dark picture that was drawn in mid-2021 in a report by Corinne Dromer, president of the Financial Sector Advisory Committee (CCSF), on the costs of pension plan (PER) policyholders.

A step towards more transparency should be taken 1er June: “Manufacturers and distributors” of these individual PERs, but also life insurance contracts, will have to “Display the frequency on their website in accordance with a standard table established in a joint agreement, under the supervision of the Ministry of Economy”explains the Service-public.fr website.
